[REVISED] RSPO Updated Statement on Hak Guna Usaha – July 2018

On 12 October 2017, the RSPO Secretariat released a statement on Hak Guna Usaha (HGU) to Indonesian stakeholders. The statement set out the requirements on legality of land, whereby an RSPO grower member’s rights to land must be in the form of a legitimate HGU and Izin Usaha Perkebunan (IUP), prior to obtaining RSPO certification.

After the issuance of this statement, RSPO Secretariat received comments from stakeholders that led to further discussion with the RSPO Board of Governors (BoG). In a meeting that took place on 27 June 2018, the BoG agreed to make a revision on the requirements, particularly with regards to management unit(s) that have obtained RSPO certification. It now states that:

1. RSPO grower members that are not certified and want to apply for RSPO certification must show evidence of possession of a legitimate HGU and IUP for the intended unit(s) of certification.
2. For RSPO grower members that are currently RSPO certified but are yet to obtain the HGU, their certification will continue and they can proceed to recertification

This requirement is effective from the date of this notice until the end of 2019. The BoG will review the application of this decision and provide further guidance thereafter.

Pada tanggal 12 Oktober 2017, RSPO mengeluarkan pernyataan kepada para pemangku kepentingan di Indonesia terkait Hak Guna Usaha. Pernyataan tersebut mengatur persyaratan legalitas lahan dimana hak atas lahan bagi anggota RSPO yang akan menjalani sertifikasi harus dalam bentuk Hak Guna Usaha (HGU) dan Izin Usaha Perkebunan (IUP) yang sah.

Setelah dikeluarkannya pernyataan tersebut, Sekretariat RSPO menerima komentar dari para pemangku kepentingan yang kemudian memicu diskusi lebih lanjut di Dewan Gubernur (Board of Governor/BoG) RSPO. Di dalam pertemuan yang dilangsungkan di tanggal 27 Juni 2018, Dewan Gubernur RSPO memutuskan untuk merevisi persyaratan tersebut, terutama terkait ketentuan bagi unit kelola yang sudah mendapatkan sertifikat RSPO yakni sebagai berikut:

1. Perusahaan perkebunan anggota RSPO yang belum bersertifikat dan ingin mengajukan sertifikasi RSPO, harus menunjukkan bukti kepemilikan Hak Guna Usaha (HGU) dan Izin Usaha Perkebunan (IUP) untuk unit yang akan disertifikasi.
2. Bagi perusahaan perkebunan yang saat ini sudah bersertifikat RSPO tetapi belum memperoleh Hak Guna Usaha (HGU), sertifikat tetap berlaku dan dapat melanjutkan ke proses re-sertifikasi.

Ketentuan di atas berlaku sejak tanggal dikeluarkannya pemberitahuan ini sampai dengan akhir tahun 2019. Dewan Gubernur RSPO akan meninjau kembali penerapan keputusan tersebut dan akan memberikan panduan lebih lanjut terkait hal ini.
